A FAMILY has slammed the 'silly' and 'out of order' actions of police after they shut down their fireworks display on Bonfire Night.

Darren and Becky Owen, who live on Nightingale Road near Elgar Avenue, said he was holding a fireworks display in his front garden for his family and the community when police officers approached and told him to stop.

The pair claimed police stopping the display really upset his 15-year-old son, who he said has mental health issues. 

But the police have said although the fireworks were being set off from a front garden, they were being directed into a public place.

The family have fireworks displays in their front garden every year and feels it is a good way of preventing youngsters from going out and holding less safe displays of their own. 

Mr Owen told the Gazette he saw a gathering of police around the corner from his house during the display and they asked if he could stop. 

He added: "I had already lit a firework and they asked me to pick it up and stop it from going off- how do you pick up a lit firework?

"Afterwards we gave out sparklers to the 15 or so children that were there, and the police were going over to them and watching them, at that point, we thought this was getting a bit silly. 

"We do this display every year, it is a family event and people come out of their houses to watch the fireworks. 

"We have spoken to our neighbours and they loved the fireworks and felt it was out of order how the police dealt with it. 

"We did it on the right day of the year, at a respectable time and we took precautions- police said the fireworks were too close to the road but they were about 10 metres away and they were in our property."

Sergeant Jason Maiden of Malvern SNT said: “While on patrol in Malvern on Tuesday, officers noticed a large number of fireworks which were being set off near the Elgar Avenue and Nightingale Road area. 

"Officers have attended for the interest of public safety and found a property on Nightingale Road to have been setting off fireworks to a large group of people gathered at the front of the address. 

"The fireworks, although being set off from a front garden of the property, were directed into a public place which is a built-up housing estate. 

"Officers gave words of advice in the interest of everyone’s safety, including families and children present. No fireworks were seized.”
