FED-up hotel guests took a homeless man's guitar as he busked outside into the early hours. 

Philip is well-known around Malvern for busking with his beloved guitar, which was stolen earlier this year while he slept.

However, its replacement has now been taken after he continued to busk outside the Foley Arms after he had been asked to move by staff.

A Wetherspoons spokesperson said the guitar was being held at the hotel and could be collected at any time.

They said: "The individual concerned had been busking without permission on the outside terrace of the hotel earlier in the evening and had been asked to stop and leave the premises by the manager on duty on a number of occasions. 

"He eventually did so and then started playing outside the front door. Mindful of our  guests sleeping above, he was again asked if he would move away.

"At this stage two hotel guests also asked him if he would do so as he was preventing them from sleeping.

"He eventually did move  but only to the other side of the road where he continued to play his guitar until 1am.

"We understand at this point that guests of the hotel independently took his guitar from him in order to stop him disturbing them further.  

"The guitar was left by the guests in the hotel and can be collected at any time."

Philip said: "It happened at around 12.30am. I was outside of The Foley Arms Hotel chatting to some people I knew.

"I was about to play some music for them when staff came outside and told me I couldn't play there so I crossed the road to play music with friends there instead.

"Some hotel residents threatened me out of their windows saying they would hit the guitar on my head.

"They came out of the hotel onto the street and threatened me and the people I was sat with."

Philip said that it was two men who came out of their hotel rooms and took the guitar from him. 

He added: "I'm entitled to sit there and play music with friends.

"They then took my guitar and walked back into the hotel saying 'what are you going to do?' and staff were watching.

"The staff were happy to watch them go back into the hotel with stolen property. 

"I asked the staff if I could have it back and they shrugged so I called the police.

"I'm not happy with Wetherspoons. When they saw residents come and procure my guitar they should have called the police.

"I'm upset about it. I'm sitting in the park with some friends now and I'm depressed that I can't play my guitar. 

"It's unnecessary. No one was breaking any law or doing any harm."
